1. Service

FirstTen is a lead discovery tool that helps freelancers and small agencies find local businesses that may benefit from their services. It surfaces business information from public sources and generates AI-assisted outreach message templates.

2. Acceptance

By creating an account or using FirstTen, you agree to these Terms. If you do not agree, do not use the service.

3. Outreach compliance — your responsibility

• CASL (Canada) — commercial electronic messages require express or implied consent. Implied consent requires a pre-existing business relationship. Violations carry fines of up to $10M CAD per day.
• CAN-SPAM Act (USA) — requires a physical mailing address and an opt-out mechanism in every commercial email.
• GDPR (EU/EEA) — requires a lawful basis (typically legitimate interest or consent) for B2B marketing communications.
• Any other local laws that apply to unsolicited commercial communications in your region or the recipient's region.

4. Data sources

Business information displayed in FirstTen is sourced from:

• Google Maps Platform (Places API) — business names, addresses, phone numbers, ratings.
• DuckDuckGo Search — website discovery for businesses with no website listed in Google Places.
• Public business websites — web presence signals (SSL, contact info, social links).

All use of this data must comply with the terms of the originating services and applicable law. You agree not to use business data discovered through FirstTen for bulk data collection, resale, or any purpose beyond your own direct outreach.

5. Google Maps Platform data

Business data sourced from the Google Maps Platform is subject to the Google Maps Platform Terms of Service. By using FirstTen you agree to comply with those terms in your use of any data sourced from Google Maps. This data is provided to support your outreach workflow and must not be extracted, resold, or used in bulk outside of FirstTen.

6. Acceptable use

You agree not to:

• Use FirstTen for spam, harassment, or unlawful contact.
• Scrape or bulk-export data from the FirstTen platform.
• Attempt to circumvent usage limits or access other users' data.
• Use the service in any way that violates applicable law.

7. No warranty

FirstTen is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of business data. Lead scores and fit ratings are algorithmic estimates — not guarantees of conversion.

8. Limitation of liability

To the maximum extent permitted by law, FirstTen and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service or the data it surfaces, including damages resulting from regulatory fines, failed outreach, or third-party claims.

9. Changes to these terms

We may update these Terms at any time. Continued use of FirstTen after changes are posted constitutes acceptance of the updated Terms.
